====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Maner P.S. Case No.200 of 2019/S.T. No.928 of 2019 registered under Sections 147, 148, 149, 341, 323 and 302/120B of the Indian Penal Code besides Section 27 of the Arms Act. The accusation is that 14 persons, named in the F.I.R., including the petitioner surround the informant Ashok Rai and his son Ramun Kumar. At that time, Bihari Rai asked the informant that at the instance of his son, police seized the liquor and other materials meant for preparing the firearms. Thereafter, Parmeshwar Rai caught hold of the son of the informant and Bihari Rai shot fire at his stomach, who died on

Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. but no specific overt act is attributed to the petitioner. The petitioner has no criminal antecedent and is in custody since 21.04.2019. Further submission is that the similarly situated co-accused Girja Rai alias Ririjan Rai has already been granted bail by a Bench of this Court vide order dated 15.11.2019 passed in Criminal Misc. No.67554 of 2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII, Danapur, Patna, in connection with Maner P.S. Case No.200 of 2019/S.T. No.928 of 2019.
