JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 The petitioner seeks regular bail in connection with S.T. No. 255 of 2018 arising out of Mansi P.S. Case No. 53 of 2018, registered for offences punishable under Sections 302 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is of committing murder of the son of the informant.
It has been submitted on behalf of the petitioner that save and except suspicion that the deceased had illicit relationship with the wife of the petitioner, there is no any circumstance to show that the petitioner committed murder of the deceased. Further submission is that petitioner has no criminal antecedent and has been in judicial custody since

Learned counsel for the State as well as the informant opposed the prayer for bail. It has been submitted by learned counsel for the petitioner that there are materials against the petitioner showing his complicity in the murder of the son of the informant.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Khagaria, in connection with S.T. No. 255 of 2018 arising out of Mansi P.S. Case No. 53 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
