2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code.

3. The case of the prosecution is that the informant namely, Satish Kumar was coming to his home on a rickshaw, as the rickshaw reached near Nai Godown police Station (T.O.P), two boys arrived and on the gun point, started taking away all the articles. It is further alleged that one of the boy assaulted with the butt of the pistol on his head and they took away the belongings.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

It is also submitted that the name of the petitioner is not there in the FIR, he was apprehended on the basis of his criminal antecedent and after that he has also given his confessional statement that nothing has been recovered from his possession. It is further submitted that the petitioner is languishing in judicial custody since 06.06.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that he is having criminal antecedent of seven cases, where he is on bail on two cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kotwali P.S. Case No. 642 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya.
