Petitioners seek bail in Banmankhi P.S. Case No.02 of 2016 instituted for the offence under Section(s) 302/34 Indian Penal Code.

In the written report, it is alleged that mother of the informant received telephonic call on her mobile. Hot talk took place between her mother and the person, who had made call. Thereafter, mother of the informant went to market, but she did not return. The informant along with her sister went to search her mother and on the next morning, one unknown Auto Driver told that one dead body is lying on Kacchi Sarak near Kabristan. The informant went there and saw the dead body of

Case diary has been received. Learned APP has submitted that in the case diary only suspicion has been raised against these petitioners. Besides suspicion, there is no specific overt act against the petitioners.

Counsel for the petitioners submits that Petitioners are in custody since 01.08.2018.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1st, Purnea, in connection with Banmankhi P.S.
