JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Petitioner prays for bail in connection with Sabour P.S.Case No. 169 of 2018 registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code. Allegation as per FIR is that dead body of a child was found lying at Kurpat Bahiyar and later on, on the information of Chaukidar the dead body was recovered, finding that he was strangulated by unknown miscreants and later on during investigation in the confessional statement of co-accused Tuntun Mandal name of petitioner has transpired and it further appears that petitioner was seen in the company of Tuntun Mandal in his house and as such they have killed the deceased. Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence and in the confessional statement Tuntun has confessed that he has killed
Patna High Court Cr.Misc. No.68022 of 2018(3) dt.20-12-2018 2/2 the deceased and there is no confessional statement of the petitioner and petitioner is a pregnant lady and is in custody since 11.6.2018.

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur, in connection with Sabour P.S.Case No. 169 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
