JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 326, 307/34 of the Indian Penal Code, and section 27 of the Arms Act.

Taking into consideration that petitioner is said to have opened fire on the chest of injured, as a result of which injured sustained firearm injury on his chest, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Session trial no. 494 of 2019 arising out of Khodawanpur P.S.Case No. 192 of 2018, pending in the court of learned 1st Additional Sessions Judge, Begusarai stands rejected.
