JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 The petitioner seeks regular bail in connection with Buxar (T) P.S. Case No. 261 of 2018, registered for offences punishable under Sections 302, 307, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation as per F.I.R. is that when the informant and his father was going towards his villages then the petitioner and one other person started firing, which hit the father of the informant in his head and the informant also received one firearm injury.

Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and he has falsely been implicated in this case. Further submission is that there is land dispute between the parties and postmortem report also shows that only one injury was found on the person of the

Patna High Court Cr.Misc. No.66801 of 2018(3) dt.05-12-2018 2/2 deceased and the petitioner is in judicial custody since 04.06.2018.

Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for bail of the petitioner on the ground that the F.I.R. clearly shows that the petitioner with other accused person fired on the deceased as well as on the informant.

Having heard both sides, in view of the above facts, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed.
