JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 The petitioner seeks bail in connection with Gardani Bagh P.S.Case No. 176 of 2018 registered under Sections 302 and 120B/34 of the Indian penal Code and 27 of the Arms Act. Allegation as per the FIR is that informant had gone for treatment of Rajan Jee at Aman Nursing Home, in the meantime, accused persons including the petitioner came there armed with country made pistol and other arms and started indiscriminate firing on them, which caused injury to Dinanath Yadav, Raj Yadav and Vijay yadav and Dinanath Yadav was taken to P.M.C.H. where he was declared dead and Raju Yadav and Vijay Yadav were admitted for treatment in Paras Hospital. Submission of learned counsel for the petitioner is that allegation against the petitioner is general and omnibus, no specific allegation has been attributed against him and petitioner
Patna High Court Cr.Misc. No.65292 of 2018(4) dt.07-12-2018 2/2 is in custody since 03.05.2018.
Heard learned APP also who has opposed the prayer for bail stating that two fire arms injury was found on the person of the deceased and apart from that the injury report of one of the injured Raj Yadav also disclosed that he has received firearm injuries and those are grievous in nature.
Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, the application stands dismissed. (Vinod Kumar Sinha, J) sujit/- U T
