====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 04-12-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with G.R.P. Bakhtiyarpur (Rail P.S. Bakhtiyarpur) Case No. 55 of 2018 registered for the offences punishable under Sections 379, 411 and 34 of the Indian Penal Code. Informant has alleged in her written complaint that she was traveling from Asansol to Buxar in Punjab Mail in a reservation compartment and when train was about to reach Bakhtiyarpur station at about 2:50 A.M. two miscreants snatched her bag and tried to flee away and on raising alarm one was caught and other managed to escape. Person who was caught, disclosed his name as petitioner and from his possession

Patna High Court Cr.Misc. No.69266 of 2018(3) dt.04-12-2018 2/2 purse, Aadhaar Card, A.T.M. and 6,200/- rupees cash were recovered.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has falsely been implicated in this case on suspicion and the real culprits fled away. He has also enclosed Annexure-2 series regarding his mental illness and being treated for anxiety and depression. He has no criminal antecedent and he is in custody since 23.05.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with G.R.P. Bakhtiyarpur (Rail P.S. Bakhtiyarpur) Case No. 55 of 2018. (S. Kumar, J) Rajiv/ManojU T
