2. This writ petition has been filed for direction to the respondents to sanction the modified ACP payable on 02.05.2015 and pay the difference of pension, unutilized E.L. and gratuity after fixing the pay as per MACP sanctioned to the petitioner.

3. Counter affidavit by the University has been filed.

4. Learned counsel appearing for the petitioner as well as for the University submits that insofar as the ACP and MACP payable to the petitioner have already been paid.

5. In such circumstances, learned counsel for the petitioner submits that this writ petition may be disposed of by allowing the writ petitioner to file a representation before the appropriate authority for refixation of the petitioner's pension on the basis of the MACP paid to the petitioner.

6. Learned counsel for the University has no objection to the prayer made by the learned counsel for the petitioner.

7. In view of the above, this writ petition shall stand disposed of with a liberty granted to the petitioner to file a representation before the appropriate authority of the University for refixation of his pension on the basis of the MACP paid to the petitioner.

8. As and when the petitioner files a representation before the appropriate authority of the University, such authority shall consider the representation filed by the petitioner in accordance with rules.

9. The writ petition is disposed of with the above directions.
