The petitioner seeks bail in connection with NDPS Case No. 78 of 2017, arising out of Adapur (Nakardei) P.S. Case No. 284 of 2017, registered under Sections 20, 22, 24 and 25 of N.D.P.S. Act, pending in the Court of learned Sessions Judge / Special Judge, East Champaran, Motihari.

The accusation is of recovery of 8.2 Kg Charas from the bag, which was being carried by the petitioner boarding on the motorcycle.

Patna High Court CR. MISC. No.69150 of 2019(4 ) dt.25-02-2020 2/2 petitioner submits that petitioner is in custody since 14.10.2017. Further submission is that, earlier, the prayer for bail of the petitioner was refused on merit on 13.02.2018 vide Criminal Miscellaneous No. 8138 of 2018.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer of the petitioner, above named, is rejected. However, the learned Addl. Sessions Judge-VI, Motihari, East Champaran is directed to conclude the trial of the petitioner by taking all effective steps within a year. (Rajendra Kumar Mishra, J) manish/- U T
