Petitioner's prayer for bail in a case registered under Sections 147, 148, 149, 307 and later on added with Section 302 of Indian Penal Code and Sections 3⁄4 of Explosive Substances Act was earlier rejected by this Court by order dated 16.05.2018 passed in Cr Misc No 17508 of 2018.
The bail application of co-accused Pintu Yadav was recently considered by a coordinate Bench of this Court on 30.11.2018 and on the basis of report received from the Court below regarding six out of eight charge sheeted witnesses having been examined, this Court has rejected the prayer for bail taking into note the considerable progress of the trial in the Court below. Under the said order dated 30.11.2018 passed in
Patna High Court Cr.Misc. No.60151 of 2018(3) dt.02-01-2019 2/2 Cr Misc No 66614 of 2018 on the bail application filed by coaccused Pintu Yadav, the trial Court has been directed to concluded the trial within three months.
In view of such developments subsequent to filing of the instant case, no order needs to be passed as already there is an order for concluding the trial within three months. Petitioner's prayer for bail is again rejected. Petitioner would, however, be at liberty to renew his prayer for bail in the event the trial is not concluded within the period of three months granted by order dated 30.11.2018 passed in Cr Misc No 66614 of 2018.
