JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-02-2024 The present writ petition has been filed seeking the following reliefs:- "i. For quashing the appellate order dated 19.01.2013 of Deputy Inspector General of Police, Bihar Military Police, Central Division, Patna, rejecting the appeal filed by the petitioner against the order dated 06.05.12 passed by Commandant, Bihar Military Police, Dumraon, dismissing the petitioner with immediate effect and hold that the petitioner was not entitled to any monetary gain except what he was paid during the period of his suspension.
Patna High Court CWJC No.54 of 2024(2) dt.22-02-2024 2/3 ii. The order dated 06.05.12 passed by Commandant, Bihar Military Police. Dumraon, District- Buxar, dismissing the petitioner as a constable under Bihar Military Police by agreeing with the report submitting by the enquiring officer.
iii. The enquiry report submitted by the enquiring officer in departmental enquiry case no-51 of 2011 initiated against the petitioner holding illegally to be guilty of indiscipline, non-discharge of duties and having character not be holding a constable."

At the outset, the learned Senior Counsel for the petitioner submits that in pursuance to the earlier order dated 23.07.2019 passed by a co-ordinate Bench of this Court in CWJC No.16293 of 2014, the petitioner had filed a representation before the Deputy Inspector General of Police, Bihar Military Police Central Division, Patna, immediately upon passing of the aforesaid order dated 23.07.2019, however, the same has not been disposed off till date, hence the respondent no.3 be directed to dispose off the same.

Having regard to the limited prayer made by the petitioner, I deem it fit and proper to direct the respondent no.3, ie. the Deputy Inspector General of Police, Bihar Military Police Central Division, Patna to consider the aforesaid application filed by the petitioner in case the same has been
Patna High Court CWJC No.54 of 2024(2) dt.22-02-2024 3/3 filed and has not yet been disposed off, and pass a reasoned and a speaking order, in accordance with law, with a period of four weeks of receipt/production of a copy of this order. 4.
The writ petition stands disposed off on the aforesaid terms.
