JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Earlier the prayer for bail of the petitioner was dismissed twice vide order dated 20.09.2017 passed in Cr. Misc. No. 40295 of 2017 and vide order dated 07.02.2019 passed in Cr. Misc. No. 1339 of 2019 and allegation against the petitioner is of firing on the brother of informant causing his death. Submission of learned counsel for the petitioner in spite of direction of this Court, the trial has not been concluded uptil now and petitioner has been in custody since 05.04.2019 and similarly situated other accused persons have already been enlarged on bail.

Heard learned A.P.P. as well as learned counsel for the informant. They have opposed the prayer for bail. It appears that vide order dated 23.10.2019, a

Patna High Court CR. MISC. No.66545 of 2019(3) dt.05-02-2020 2/2 report with regard to stage of trial was called for from the Trial Court and from perusal of the same, it appears that case is fixed for evidence of the defence.

In such view of the matter, I am not inclined to enlarge the petitioner on bail. The prosecution as well as petitioner is directed to cooperate in expeditious disposal of trial.

This application is accordingly dismissed.
