The petitioner has prayed for grant of bail in connection with Kanti P.S. Case No. 412 of 2023 registered under sections 304B, 201 and 34 of the Indian Penal Code. It is a case of dowry death of the informant's daughter due to non-fulfillment of dowry demand.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is father-in-law of the deceased due to which he has falsely been implicated in this case. He has no concern with mess and business of the deceased as well as from her husband and also he lives separately from them. Moreover, the petitioner is languishing in judicial custody since 07.06.2023.

Having heard learned counsel for the parties and considering the facts and circumstances of this case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Kanti P.S. Case No. 412 of 2023 furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Court No-6, (West) Muzaffarpur.
