The petitioner seeks regular bail in connection with Brahmpura P.S.Case No.313 of 2017 registered for offences punishable under Sections under Section 379 & 420 of the Indian Penal Code.

Allegation against the petitioner as per FIR is that the informant had gone to the ATM centre to check his balance in the meantime, one person came at the ATM counter and told him that it is not connected with the Adhar as such the same will not disclose the balance and he came back to his house and thereafter he got messages that Rs.40,000/- has been withdrawn and the same has been transferred in the account of the petitioner.

Patna High Court Cr.Misc. No.67715 of 2018(3) dt.07-12-2018 2/2 Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and the TIP has also not been conducted. He is in custody for six months. Heard learned A.P.P. also,w ho has opposed the prayer for bail on the ground that the petitioner has criminal antecedent and he is accused in two other cases.

Having heard both sides and in view of the facts and circumstances, at this stage I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail after framing of the charge.

With the aforesaid observation, this application is dismissed.
