JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-11-2024 Though the present writ petition has been filed for quashing the order dated 13.9.2024, passed by the District Magistrate, Patna, in Arms Case No. IX-226/2023, whereby and whereunder the application of the petitioner for grant of additional arms license has been rejected, however, at the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the same, by filing appropriate appeal, under Section 18 of the Arms Act, 1959, before the Appellate Authority, nonetheless, seeks a direction upon the Appellate Authority to decide the same within a stipulated time

Per contra, the learned counsel for the Respondent-State submits that in case, appropriate appeal is filed, the same shall definitely be disposed off within a stipulated time frame, as is fixed by this Court.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant liberty to the petitioner to file appropriate appeal, challenging the aforesaid order dated 13.9.2024, passed by the District Magistrate, Patna and in case, such an appeal is filed within a period of four weeks from today, the Appellate Authority shall consider the same, in accordance with law and pass a reasoned and a speaking order within a period of six weeks, thereafter.

Accordingly, the present writ petition stands disposed off on the aforesaid terms.
