The petitioner apprehends her arrest in a case registered for the offence punishable u/s 409, 420 and 34 of the IPC. As per the prosecution case, petitioner along with other accused is said to have committed forgery of Rs.7,00,000/- with one Raimul Khatoon by abusing their post.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. She has been falsely implicated in this case. It is alleged that the informant had given Rs.7,00,000/- in the post office for depositing the same in the savings account but only Rs.1 Lac was deposited by the petitioner and other co-accused by making over-writing in the passbook that Rs.7 Lacs has been deposited. Enquiry was done by the Postal Department and it was found that the prosecution case was true. It is submitted that there is no

Patna High Court CR. MISC. No.5320 of 2023(2) dt.10-04-2023 2/2 specific allegation against the petitioner and only to save the main culprit, petitioner has been made accused in this case. Petitioner is ready to deposit Rs.1.5 Lacs in the account of the informant within a period of eight weeks.

Under the aforesaid circumstances, petitioner is directed to deposit Rs.1.5 Lacs/- in the account of the informant within a period of eight weeks from today.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on provisional bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Parihar P.S. Case No.196 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. The provisional bail of the petitioners shall be confirmed by the learned court below itself on showing the receipt of deposit of the aforesaid amount in the account of the informant within the stipulated period.
