2. This appeal is preferred against the order dated 15.07.2024 passed by the learned Exclusive Special Judge, SC/ST, Gaya in A.B.P. No. 203 of 2024 in connection with Konch P.S. Case No. 608 of 2023 registered under Sections 341, 323, 354(B), 504, 379 & 34 of the Indian Penal Code and under Section 3(1)(r), 3(1)(w) and 3(2)(va) of the SC/ST Act and Section 12 of P.O.C.S.O. Act by which the prayer of the appellants for grant of anticipatory bail has been rejected.

3. As per the prosecution case, the appellants

Patna High Court CR. APP (SJ) No.4989 of 2024(5) dt.27-11-2025 2/2 allegedly misbehaved with informant and even assaulted informant's father and abused him by taking his caste name.

4. It has been submitted by the learned counsel for the appellants that the appellants are innocent and they have been falsely implicated in this case.

5. Learned counsel for the State has vehemently opposed the application of the appellant.

6. From the reading of the FIR, this Court is of the view that this is not a fit case for grant of anticipatory bail.

7. Accordingly, this appeal stands dismissed and the interim protection granted to the appellants vide order dated 16.12.2024, is hereby vacated.

8. The appellants are directed to surrender within four weeks from today failing which the Superintendent of Police, Gaya will take all steps for arrest of the appellants.

9. Let a copy of this order be communicated to the Superintendent of Police, Gaya through FAX for its compliance. (Sandeep Kumar, J) tusharika/- U T
