The petitioner apprehends her arrest in a case registered for the offence under Sections 498(a) & other allied sections of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.
Allegation against petitioner and other accused persons is that they committed torture and cruelty to the informant for dowry.
Petitioner is second wife of husband of the complainant/informant.
It is submitted on behalf of petitioner that husband of the informant has already been granted bail. There is no specific
Patna High Court CR. MISC. No.5374 of 2023(2) dt.10-04-2023 2/2 allegation against this petitioner and she has been made accused in this case only because she happens to be second wife of husband of informant.
In view of aforesaid facts and circumstances, let the above named petitioner, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura in connection with Ariyari P.S. Case No. 71 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
