The petitioner is apprehending arrest in connection with Nautan P.S. Case No. 170 of 2019 for the offence under Section 420, 467, 468, 471/120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is Ward Member and he has no role to play in the process of selection of Panchayat Shikshak. In fact decisive roles are played by Mukhiya and Panchayat Secretary. He further submits that in the similar circumstances, other accused persons have been granted bail by the Coordinate Bench of this Court.

Considering the fact that the petitioner is neither

Patna High Court CR. MISC. No.70450 of 2019(3) dt.06-03-2020 2/2 Mukhiya nor Panchayat Secretary, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within four weeks from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran at Bettiah in connection with Nautan P.S. Case No. 170 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
