JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-03-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 395/397 of the Indian Penal Code.

As per the prosecution case, five unknown persons on the point of pistol took away tractor of the informant. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. petitioner's name has come in the case on the confessional statement of coaccused. No incriminating material has been recovered from the conscious possession of the petitioner.

Learned counsel for the State opposes the prayer for bail submitting that petitioner has got two criminal antecedent and it has come in course of investigation that he along with

Patna High Court CR. MISC. No.1584 of 2023(2) dt.27-03-2023 2/2 other accused persons snatched the informant's tractor on the point of pistol.

Considering the specific allegation against the petitioner and his criminal antecedent, prayer for bail of the petitioner is refused.
