The petitioner seeks regular bail in connection with Pipra P.S. Case No. 114 of 2016 registered for the offence punishable under Section 395 of the Indian Penal Code. The case of the prosecution is that while the informant had proceeded from Delhi with his rice loaded truck towards Madhubani, a six wheeler truck and a Bolero Jeep followed him and overtook the truck of the informant near Muzaffarpur and on pistol point took away the rice loaded truck and cash amounting to Rs. 30,000/- and a mobile.

Learned counsel for the petitioner submits that the petitioner is innocent and on account of his criminal antecedent, he has been falsely implicated in the present case upon

It is further submitted that no recovery has been made from the petitioner. However, the rice loaded truck was found parked at Bata Chowk, Raxaul. The petitioner is stated to be languishing in custody since 06.08.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Pipra P.S.
