Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Excise P.S. Case No. 416 of 2022 lodged under Sections 30(a) and 32(b) of Bihar Prohibition and Excise Act, 2018. As per the prosecution case, the total recovery of 138.240 litre wine has alleged to be made from the vehicle in which the petitioner was alleged to be driver of the said vehicle. Learned counsel for the petitioner submits that under confusion, he was accepted to drive the said vehicle. Counsel further submits that petitioner's antecedent is clean and he is in

Patna High Court CR. MISC. No.74906 of 2022(2) dt.25-03-2023 2/2 custody since 04.09.2022. Counsel submits that he is ready to fulfill all the conditions whatsoever shall be imposed upon him. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge 2nd-cum- Exclusive Special Judge 1st Excise, Saran at Chapra in connection with Excise P.S. Case No. 416 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
