The petitioner is languishing in custody in connection with P.R. No. 35 of 2019 (179 of 19) for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is regarding recovery of 19.680 litres of illicit foreign liquor from the possession of the petitioner. Learned counsel for the petitioner submits that the prosecution report has been submitted without proper investigation of the case. It is further submitted that the petitioner is in custody since 19.09.2019.

Considering the statement of the petitioner on oath that he has got no criminal antecedent, let the petitioner, above

Patna High Court CR. MISC. No.75901 of 2019(2) dt.29-11-2019 2/2 named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with P.R. No. 35 of 2019 (179 of 19) with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court below; and (b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
