The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 354(B), 506, 376, 511 of the Indian Penal Code and Section 8 of POCSO Act.
Allegation against the petitioner is that he outraged the modesty of the daughter of the informant. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. During
Patna High Court CR. MISC. No.74260 of 2022(2) dt.23-03-2023 2/3 investigation, witnesses have not supported the prosecution version except parents of the victim. It is further submitted that informant has taken loan Rs, 20,000/- from the petitioner and when the petitioner demanded his money back, informant has lodged F.I.R. against the petitioner with false and concocted allegations. It is also submitted that petitioner is languishing in judicial custody since 11.12.2021. Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Warisaliganj P.S. Case No. 210 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District &
