Petitioner apprehends his arrest in connection with Laheriasarai P.S. Case No.419 of 2017, for the offence punishable under Sections 420, 467, 468, 406/34 of the Indian Penal Code. The accusation is that petitioner approached to Asraf Hussain to sell 3 katha of land and consideration amount of the land was agreed to be paid worth Rs.4,30,000/-. The informant gave Rs. 2 lakhs as advance to the petitioner. On 22.04.2015 complainant went to registry office where the sale deed was executed handing over the remaining amount of Rs.2,30,000/- but due to nonavailability of the witness, the sale deed could not be registered on that day, thereafter, on much persuasion petitioner did not turn up. No.72068 of 2019(3) dt.21-11-2019 2/2 petitioner talked to sell the two plots to the complaint / informant and in respect to land detailed in complaint petition, he executed the sale deed and the same has been registered which would appear from Annexure-2 but the complainant /informant started to put pressure to execute the other sale deed in respect of other land but petitioner was not ready to execute the sale deed without giving full consideration amount and only to put pressure, the present has case been lodged.

Having regard to the facts and circumstances of the case, let the above named petitioner, Md. Akeel Ahmad @ Aqueel Ahmad, be released on bail, in the event of pre-arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Darbhanga, in connection with Laheriasarai P.S. Case No.419 of 2017, subject to the condition as laid down under Section 438 (2) of Cr.P.C.
