Mr. Anil Prasad Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 19-03-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Lalganj P.S. Case No. 362 of 2021, lodged on 10.10.2021 under Sections 304 (B), 34, 328 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against 4 named accused persons including the present petitioner against whom there is an allegation that they have killed the informant's daughter by giving her poison.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the petitioner is the husband and his wife was ill and during the treatment, death has been caused. Counsel further submits that the criminal antecedent of the petitioner is

Patna High Court CR. MISC. No.78467 of 2023(4) dt.19-03-2024 2/2 clean and he is in custody since 11.10.2021. Counsel also submits that charge has already been framed in this case.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. Learned counsel for the informant vehemently opposes the prayer for bail of the petitioner and submits that it is a case of dowry death in which there is direct involvement of the petitioner and his family members.

7. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner at this stage.

8. Accordingly, the prayer for regular bail of the petitioner in connection with Lalganj P.S. Case No. 362 of 2021, pending before the learned Additional Sessions Judge-IV, Vaishali at Hajipur is hereby rejected.

9. Liberty is hereby granted to the petitioner that he may renew his prayer for bail nine months from today.

10. In the meantime, the Trial Court is directed to conclude the trial.
