1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 21(C) of the NDPS Act as well as Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. Learned counsel for the petitioner submits that petitioner had earlier moved before this Court seeking bail by filing Cr. Misc. No. 50720 of 2024 and the same was permitted to be withdrawn by an order dated 26.07.2024 with liberty to the petitioner to renew his prayer for bail after framing of charge. Learned counsel further submits that charges against the petitioner have been framed on 13.09.2024 (Annexure-4 to the bail application).

4. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner and submits that if privilege of bail is

Patna High Court CR. MISC. No.76801 of 2024(2) dt.25-10-2024 2/2 granted, the petitioner may abscond on which learned counsel appearing on behalf of the petitioner submits that petitioner will not abscond rather would cooperate in the trial to prove his innocence.

5. Considering the aforesaid submissions, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with NDPS Case No. 64 of 2024 arising out of Madhepura (Ghailardh O.P.) P.S. Case No. 1162 of 2023.

6. One of the bailors of the petitioner shall be his father, namely, Ramesh Yadav.

7. It is made clear that if the learned trial court comes to a conclusion that petitioner, after his release on bail, is trying to delay the trial of the case in any manner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner and to take all coercive steps to ensure that petitioner is behind bar.
