JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bajpatti P.S. Case No. 371 of 2018 registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code.

Admittedly, after due investigation, charge sheet was filed against father of the petitioner who was put on trial in Sessions Trial No. 194 of 2019. Furthermore, it is an admitted position that in the aforesaid trial, one co-villager Murari Shankar Sah was examined and disclosed that it was Hari Om Kumar who took away the minor daughter of the informant. So far as petitioner is concerned, he happens to be brother of

No.66626 of 2019(3) dt.06-03-2020 2/2 aforesaid Hari Om Kumar and the case diary goes to show that when the informant went to make enquiry about the whereabouts of his daughter, petitioner and his father are said to have abused him and except the aforesaid material, there appears to be nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Pupri, Sitamarhi in Bajpatti P.S. Case No. 371 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
