JUSTICE RAJESH KUMAR VERMA ORAL ORDER 29-04-2023 Heard Mr. Jitendra Kumar Giri, learned counsel for the petitioner and learned APP for the State. Petitioner seeks bail, who is in custody since 12.09.2022, in connection with Ekangarsarai P.S. Case No. 224 of 2022, F.I.R. dated 12.09.2022 registered for the offences punishable under Section 354(B) of the Indian Penal Code and Sections 8/12 of the POCSO Act.

Learned counsel for the petitioner submits that during the pendency of the bail petition, the petitioner has been acquitted from the charges as alleged in the F.I.R. and hence the petition has become infructuous and seeks permission to withdraw the petition.

Permission is accorded.
