Mr. Asha Devi, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-07-2020 Heard Mr. Pushpendra Kumar Singh, learned counsel for the petitioner and Ms. Asha Devi, learned APP for the State.

The petitioner seeks modification of the order dated 04.07.2019 passed in Cr. Appeal No. 1707 of 2019, whereby he was granted anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from the date of passing of the order. The petitioner could not surrender within the aforesaid stipulated period.

For the reasons stated in the application, the

Patna High Court CR. MISC. No.74813 of 2019(2) dt.01-07-2020 2/2 prayer made on behalf of the petitioner for modification of the order, referred to above, is allowed.

In case the petitioner surrenders before the court below within a period of six weeks from today, he shall be accorded the privilege under the order dated 04.07.2019 but all the terms and conditions which have been imposed in the aforesaid order shall subsist.

The order dated 04.07.2019 stands modified to the extent indicated above.

The modification application stands allowed.
