The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.
The petitioner is alleged to have made indiscriminate firing upon the informant which hit Muntun Singh @ Pramod Singh and Ajay Singh, the brother of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is case and counter case between the parties and the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application.
Learned counsel for the State opposes the prayer for
Patna High Court CR. MISC. No.76099 of 2019(4) dt.21-06-2022 2/2 anticipatory bail of the petitioner by submitting that as per the FIR the allegation is that the petitioner fired which hit Muntun Singh @ Pramod Singh and Ajay Singh.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
However, if the petitioner surrenders before the learned court below within a period of six weeks from today and seeks regular bail, the learned court below shall consider the prayer for regular bail of the petitioner in accordance with law. (Anjani Kumar Sharan, J.) Sanjay/- U T
