JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2025 Heard Ms. Bela Singh, learned counsel appearing on behalf of the petitioner and Mr. Pramod Kumar Pandey, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 132, 121(1), 109, 352, 309(5) and 3(5) of the B.N.S..
3. As per prosecution case, it is alleged that all the F.I.R. named accused persons, including this petitioner, attacked on the police party as a result of which some of the police personnel sustained injuries and thus, created hindrance in discharge of their official duty.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.72594 of 2025(2) dt.01-11-2025 2/2 behalf of the petitioner that petitioner is quite innocent and has committed no offence. From bare perusal of the F.I.R. it is apparent that there is no specific allegation of assault or any overt act against the petitioner. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other accused persons, attacked upon the police party as a result of which some police personnel sustained injuries and thus, created hindrance in discharge of their official duties.
6. Considering the facts and circumstances of the case, accusation that this petitioner attacked upon the police party and has taken law in his hands, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
