This is an application for grant of regular bail in connection with Amas P.S. Case No. 132 of 2018 registered for the offence punishable under Section 304(B) of the Indian Penal Code.

The case of the prosecution is that the petitioner herein had killed his wife on account of certain quarrel having taken place between them.

The learned counsel for the petitioner submits that the wife of the petitioner was mentally sick and had succumbed to her injuries after meeting with an accident.

Having considered the facts and circumstances of the case, I find that the petitioner is the main & sole accused in the

Patna High Court Cr.Misc. No.69975 of 2018(3) dt.09-01-2019 2/2 present case and there is ample materials on record i.e. in the case dairy to show that the petitioner had murdered his wife, hence I do not find it fit and proper to grant bail to the petitioner herein, hence, the prayer of the petitioner for grant of regular bail is rejected. However, the trial court is directed to expedite the trial and ensure that the trial is completed within a period of eighteen months from today. In case, the trial is not completed within eighteen months, the petitioner shall be at liberty to renew his prayer for regular bail.
