The petitioner is languishing in custody since 15.10.2018 in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that from the cloth shop of the petitioner, 45 litres foreign liquor and illicit 39 litres beer were recovered from the cloth shop of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner was not aware about the storage of the liquor and the same might have been stored by the employees. It is further submitted that though the petitioner is accused in a case of petty nature of offence but he is on bail in that case and the investigation has already been completed.

Learned APP submits that the accusation of storage of liquor is against the petitioner.
