JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a, 26/35 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

No doubt, petitioner was caught on the spot but according to prosecution case itself, nothing was recovered from the conscious possession of the petitioner. Petitioner does not have any criminal antecedent and is languishing in jail custody since 19.08.2019. Moreover, having more or less similar allegation, co-accused Suman Kumar and Manish Kumar have

Accordingly, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd cum Special Judge, Excise Act, Samastipur in connection with Samastipur Muffasil P.
