The petitioner seeks bail in S.Tr.No.89 of 2018 arising out of Andhramath P.S. Case No.76 of 2017 / G.R.No.1242 of 2017 registered under Section 304 (B)/34 of the I.P.C. Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 11.01.2018 passed in Cr.Misc.No.62100/17 with direction to the trial court to expedite commitment of the case and once the case is committed, expedite the trial also and the allegation against the petitioner is that he is brother-in-law (Dewar) of the deceased and he along with other co-accused tied the deceased and set her on fire. Submission of the learned counsel for the petitioner is that the petitioner is in custody since 19.08.2017 but up till now
Patna High Court Cr.Misc. No.66417 of 2018(3) dt.28-11-2018 2/2 not a single witness has been examined.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
However, learned trial court is directed to expedite the trial conducting on day to day basis so that the trial may be concluded within a period of one year.
