The petitioner seeks bail in connection with Salkhua P.S. Case No. 114 of 2018 instituted for the offence under Section(s) 341/323/307/302/34 of the Indian Penal Code. It is alleged in the written report that on the date of occurrence the son of this petitioner Lalan Yadav and Sajjan Yadav assaulted cousin father-in-law of the informant, namely, Ram Bilash Yadav causing injury in his head. It is further alleged that when the father-in-law of the informant went to save Ram Bilash Yadav both of them assaulted the father-in-law of the informant with bamboo causing injury to him on the head. It is further alleged that thereafter petitioner also arrived armed with bamboo and assaulted the father-in-law of the informant

Patna High Court Cr.Misc. No.73654 of 2018(3) dt.11-01-2019 2/2 who subsequently died in the hospital.

Case diary has been received in this case, wherein, postmortem report of the father-in-law of the informant is available, wherein, the doctor has found only one injury on the person of deceased.

In the written report it is mentioned that son of this petitioner namely Lalan Yadav and Sajjan Yadav have assaulted the father-in-law of the informant with bamboo. Thereafter, it is alleged that this petitioner also arrived armed with bamboo. Petitioner is in custody since 27.05.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Saharsa in connection with Salkhua P.S. Case No. 114 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
