No.384 of 2017 (Harendra

C.W.J.C. No.8418 of 2010 (Sheo Bhajan Prasad Diwakar & Ors. Vs. The State of Bihar & Ors.) and another analogous cases were allowed by order dated 21.04.2011 passed by the learned Single Judge of this Hon'ble Court in which learned Single Judge has directed the appellants to identify instructors who were validly appointed and lost their jobs on account of closure of the programme and issue orders for their absorption.

The State of Bihar preferred LPA being LPA No.1489 of 2011 against the order dated 21.04.2011 passed in C.W.J.C. No. 8418 of 2010 and other analogous cases (State of Bihar vs. Sheo Bhajan Prasad Divakar and others) which was dismissed by Division Bench by order dated 11.08.2015 against which State of Bihar preferred SLP giving rise to Special leave to Appeal (C) No.32079 / 2015 which was dismissed by the Apex Court by its order dated 26.2.2016 with certain observations, which reads as follows:- "We find no infirmity in the order impugned herein. The Special Leave Petitions are dismissed.

The relief granted by the High Court shall be restricted to those who approached the High Court who were heard as well as who wanted to get themselves impleaded and those who have filed applications here at par with those former as well as all those

47/49 petitioner Instructors which are pending as on date before the High Court but shall not apply to any fresh case either here or before the High Court.

Pending applications, if any, stand disposed of." Civil Review No.291 of 2016 (Meera Kumari and Ors. Vs. State of Bihar and Ors) was filed for review of the order dated 11.8.2015 passed in LPA No.1489 of 2011 and other analogous cases which was directed to be converted into a modification petition by order dated 6.10.2016 and accordingly, same was converted as MJC No.3765 of 2016 (Meera Devi and ors. Vs. State of Bihar) which was disposed of vide order dated 25.1.2017, paragraph nos.3, 4, 5 and 6 of which reads as under:- "3. To us, problem is simple. The Apex Court, in the case of Ashwani Kumar & Others -Versus- State of Bihar & Others since reported in AIR 1997 Supreme Court 1628, in paragraph 17, has clearly held that all persons, similarly situated, whether they have moved the Court or not, must be similarly treated.

Those, who were waiting in the wings, cannot be denied the relief which is granted by the Court unless the relief is personal to the person. In our view, similar is the provision of Clause 4 (c) of the Bihar State Litigation Policy which clearly envisages that not everybody is required to move the Court. Persons, in similar circumstances, must be treated similarly.

4. In that view of the matter, all we say is if the authorities find that the petitioners are similarly circumstanced to the other persons, they would be similarly treated. 5 This application is, accordingly, disposed of with the aforesaid direction.

6. IAs No. 4666 and 7159 of 2016 are also allowed." Thereafter, a writ petition was filed by similarly situated employees being C.W.J.C. No.384 of 2017 (Harendra Mishra and 98 Ors. Vs. State of Bihar) and in view of order passed in MJC No.3765 of 2016 (Meera Kumari and ors. Vs. State of Bihar), similar relief was granted in terms of judgment and order dated 21.4.2011 passed in C.W.J.C. No. 8418 of 2010 and other analogous cases (State of Bihar vs. Sheo Bhajan Prasad Diwakar and others). Thereafter, several writ petitions were filed for similar relief and same were allowed. As order of modification passed in MJC No.3765 of 2016 (Meera Kumari and ors. Vs. State of Bihar) was in teeth of judgment and order dated 26.2.2016 passed by the Apex Court in Special leave to Appeal (C) No.32079 / 2015, State of Bihar preferred SLP against said order and the Apex Court stayed the operation of the order passed in MJC No.3765 of 2016, as such, the order on basis of which, writ petitions were allowed has been stayed by the Apex Court.

The LPAs and writ petitions as well as MJCs are disposed of with direction to the State authorities to abide by the judgment and order of the Apex Court to be passed in MJC No.3765 of 2016.

49/49 Liberty is also granted to petitioners/respondents/ appellants to approach this Court on same or subsequent cause of action, if so required.
