In this case, the petitioners are apprehending their arrest in connection with Katihar (T) P.S. Case No. 518 of 2019 registered for offences under sections 365, 120(B) of the Indian Penal Code.

In the present case, an allegation has been made against the accused persons to have made the daughter of the Informant traceless but, from the records, it appears that the husband and wife were residing earlier in Ludhiyana from

Patna High Court CR. MISC. No.72197 of 2019(5) dt.14-07-2020 2/3 where she fled away. She was traced out by the police and was handed over to her husband. Thereafter, the husband came to Delhi in search of job but, she again fled away from there. Again the police searched her and handed over her to the husband. When they came to the village Katihar, she again fled away.

The petitioners are family members of the husband and have nothing to do with that incident.

From paragraph nos. 6 and 7 of the Case Diary, it appears that the lady is in the habit of fleeing away from the house and after some time, she uses to return. Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of twelve weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar (T) P.S. Case No. 518 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they
