2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Amendment Act 2018 .

3 . It is alleged that 21.6 liters of foreign liquor was recovered from the room of apprehended co-accused Ashish Kumar Giri.

4. It is submitted that the petitioner is innocent and his name transpired in this case only for the reason that he happens to be owner of the said room from where alleged recovery has been made. The room in question was given on rent. He further submits that without his knowledge and consent, co-accused

Patna High Court CR. MISC. No.79330 of 2024(3) dt.09-10-2025 2/2 kept the illicit liquor and this petitioner has got no concern with the aforesaid recovery . Petitioner has got no criminal antecedent of similar nature .

5 . Learned counsel for the State opposes the bail petition .

6. Considering the aforesaid facts and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. - Ist Bhojpur Ara in connection with Ara Town Police Station Case No. 597 of 2023 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
