The petitioners apprehend their arrest in connection with Mansahi P.S. Case no. 67 of 2019, registered under Section 341, 323, 504 and 353/34 of the Indian Penal Code.

The accusation is that in course of patrolling duty, the informant received information about Puja Devi, wife of Santosh Kumar Ram victim of Mansahi P.S. Case No. 49 of 2019 at her Myaka in village-Nawabganj then informant along with other Police personnel reached there for the purpose of recovery of victim Puja Devi, but Sarita Devi, mother of victim Puja Devi, Rahul Kumar, brother of Puja Devi, grandmother of

Patna High Court CR. MISC. No.72295 of 2019(2) dt.19-11-2019 2/2 Puja Devi and others did not permit him to take the victim Puja Devi for recording the statement under Section 164 of the Cr.P.C. and they also abused the informant and other Police personnel.

Learned counsel for the petitioners submits that, in fact, Police had gone in the mid night to take Puja Devi (Petitioner No.2) at Police Station due to that reasons petitioner No.1 and others raised objection, but with ulterior motive the informant lodged the present case with false case. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Mansahi P.S. Case No. 67 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
