JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Gayghat P.S. Case No. 173 of 2017 for the offence under Sections 147, 148, 149, 364, 511, 341, 323, 342 of the Indian Penal Code and Sections 25(1-B)a, 26, 27 and 35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 12.08.2017. He submits that the similarly circumstanced other co-accused has been granted bail in Cr. Misc. No. 16129 of 2018 on 13.04.2018. Considering the fact that the petitioner has remained in custody for nearly one year and five months and also the fact that similarly circumstanced other co-accused has been granted bail, the petitioner, named above, is directed to be released on
Patna High Court Cr.Misc. No.72260 of 2018(3) dt.09-01-2019 2/2 bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-15, Muzaffarpur in connection with Gayghat P.S. Case No. 173 of 2017.
