The petitioner apprehends his arrest in connection with Falka P.S. Case No.111 of 2019 registered under Sections 399 and 402 of the Indian Penal Code besides Sections 25(1b)a, 26 and 35 of the Arms Act. The accusation is that on receiving the secret information about gathering of the miscreants at the door of Rajesh Yadav for making the plan to commit the crime, the informant along with other police personnel reached there. On seeing the police party, some persons started to flee away. While on chase, three persons were apprehended, who disclosed their name as Rajesh Yadav, Sanoj Kumar Mandal and Shankar

Patna High Court CR. MISC. No.67322 of 2019(2) dt.15-11-2019 2/2 Dayal Singh. On query, they also disclosed the name of their two associates, who succeeded to flee away, as Pravesh Singh and Manoj Jaiswal (petitioner).

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot rather his name has come in the confessional statement of the aforesaid apprehended accused. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Falka P.S. Case No.111 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
