Petitioners are in custody in connection with Alauli P.S. Case No. 17 of 2018 for the offence under section 302/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioners have no criminal antecedent.
Referring to prosecution case, he submits that petitioners have been made accused only on suspicion that these petitioners have illicit relation with the wife of the deceased, as such they are instrumental in eliminating the deceased.
Learned counsel submits that co-accused Kanchan
Patna High Court Cr.Misc. No.72333 of 2018(4) dt.25-01-2019 2/2 Devi has been granted bail vide order dated 18.9.2018. Considering the fact that petitioners have no criminal antecedent and they are in custody since 19.10.2018, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrat, Khagaria, in connection with Alauli P.S. Case No. 17 of 2018, G.R. No. 145 of 2018 subject to the condition that the petitioners shall extend full cooperation in conclusion of trial. The trial court is directed to conclude the trial within a period of nine months and in the event, the petitioners in any manner cause any hindrance in conclusion of trial, the trial court shall be at liberty to cancel the bail bonds of the petitioners.
