The petitioner apprehends his arrest in connection with Warisnagar (Mathurapur O.P.) P.S. Case No.244 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving the information about unloading the illicit liquor from the vehicle at the bush near bamboo clamps, situated inside the road, connecting Sati Chowk to Mannipur, the informant along with other police personnel reached there. On seeing the police party, four persons started to flee away from there but out of them, two were apprehended, who disclosed their name as Akhilesh Kumar and Aman Kumar Rai alias Guddu and also disclosed the name of his two associates, who succeeded to flee away as Angad Kumar alias Prabhat (petitioner) and Shibu alias Shivnath.

Patna High Court CR. MISC. No.68120 of 2019(2) dt.15-11-2019 2/2 On search, 10 cartoons, each containing 24 bottles of 375 ml., and 12 opened bottles, Indian Made Foreign Liquor were recovered from there.

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot rather his name has come in the confessional statement of the apprehended accused. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Samastipur, in connection with Warisnagaar (Mathurapur O.P.) P.S. Case No.244 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
