====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 09-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bettiah Town P.S. Case No. 807 of 2018 instituted for the offence under Sections 398, 401 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act.

It is alleged in the written report that police has apprehended two persons including petitioner. Police searched them and one loaded country made Katta has been recovered from possession of the petitioner.

It is mentioned in paragraph-3 of the bail petition that one case bearing Bettiah (M) P.S. Case No. 606 of 2012 is pending against the petitioner.

Patna High Court Cr.Misc. No.73347 of 2018(3) dt.09-01-2019 2/2 Report regarding antecedent of the petitioner was called for from the Superintendent of Police which has been received. From the report it appears that besides aforesaid case as mentioned in paragraph-3 of the bail petition no other case is pending against the petitioner.

Petitioner is said to be in custody since 15.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, in connection with Bettiah Town P.S. Case No. 807 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
