2. The petitioner has prayed for bail in a case registered for the offence punishable under Section 379 of the I.P.C.
3. The case of the prosecution is that the informant is an Assistant Manager in South Bihar Rural Bank, Bihar Sharif. On the date of occurrence he had parked his bike below the office and when he returned after office hour, his motorcycle was no there. On the basis of above written report FIR was registered against unknown miscreants.
4. Learned counsel appearing on behalf of the petitioner has submitted that during investigation, one Jitendra Kumar was apprehended. It has been submitted that he has given his statement in Bihar Sharif P.S. Case No.620 of 2020 i.e.
Patna High Court CR. MISC. No.78082 of 2024(3) dt.06-02-2025 2/2 in different case and on the basis of confessional statement of Jitendra Kumar, this petitioner was made accused. As per the confessional statement of Jitendra Kumar he has sold that bike to this petitioner. It has been submitted that the bike was not recovered either from Jitendra Kumar or from this petitioner. The petitioner is in custody since 25.08.2024.
5. The application for bail is opposed by learned APP for the State. He submits that the petitioner is having criminal antecedent of seven cases.
6. Having heard learned counsel for the parties and considering the above facts and circumstances, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Chief Judicial Magistrate, Nalanda in connection with Bihar P.S. Case No. 529 of 2020.
7. Accordingly, the present bail application stands allowed.
