2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that 215.2 liters of country made liquor recovered from a bike and a car. Petitioner is one of the persons who allegedly has fled away after seeing the police.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. No one was apprehended from the spot. It is further submitted by learned counsel for the petitioner that petitioner is neither the car owner nor the bike

Patna High Court CR. MISC. No.77606 of 2024(3) dt.27-01-2025 2/2 owner. Nothing has been recovered from his conscious possession. Moreover, he is languishing in judicial custody since 31.08.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that petitioner has two criminal antecedents of similar nature.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chiraiya P.S. Case No. 323 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court, No.-1 Motihari, East Champaran.
